Collusion at Kyivpastrans tenders: 2 companies fined UAH 51 million

The Antimonopoly Committee has uncovered collusion between Stellar Lim 2024 LLC and Staled LLC at two tenders and one auction of the Kyivpastrans utility company. This was reported by Komersant ukrainskyi with reference to the AMCU.

The bidding concerned the purchase of diesel fuel with an expected value of UAH 238 million, and the auction concerned the sale of an oil depot with a price of UAH 5.5 million.

During the consideration of the case, the AMCU established the circumstances that, taken together, indicate that Stellar Lim 2024 and Staled committed anticompetitive concerted actions to eliminate competition between them during participation in these auctions. The revealed facts testified to the unity of the defendants’ economic interests, common and coordinated behavior of the companies during the preparation and participation in the bidding, the AMCU said.

For committing the conspiracy, both companies received fines totaling more than UAH 51.5 million. In addition, according to the Law of Ukraine “On Public Procurement,” companies held liable for anticompetitive concerted actions that distort tender results cannot participate in procurement procedures for three years.

According to open registers, Stellar Lim 2024 (during the bidding and auction, the name was Tradlim LLC) is registered in Vyshneve, Kyiv region. The owner of the company is Stellar Star Ltd from the Marshall Islands. The beneficial owner is a Romanian citizen, Andrei Josu.
