Payments to families of missing soldiers: President signs important bill
19 November 21:42President of Ukraine Volodymyr Zelenskyy has signed Bill No. 11407, which allows the military to decide who will receive payments if they go missing or are taken prisoner. This was reported by Komersant ukrainskyi with reference to the draft law card on the parliament’s website.
According to the document, a serviceman has the right to draw up a personal order in a free-written form.
If a serviceman does not draw up a personal order, the money will be paid in equal parts first to his wife (husband), legal representatives of children, parents, and secondly to adult children, brothers, and sisters.
What does draft law No. 11407 provide for?
In the draft law, its authors proposed to restate paragraph 6 of Article 9 of the Law of Ukraine “On Social and Legal Protection of Servicemen and Members of Their Families,” which provides for
payment of financial support to family members (persons) of servicemen is carried out after deductions made in accordance with the procedure established by the Law of Ukraine “On Enforcement Proceedings”;
introduction of a new approach to the distribution of the due financial support of servicemen by identifying persons at their personal disposal in case of capture of a serviceman or hostage, as well as internment in neutral states or disappearance;
determination by the Cabinet of Ministers of Ukraine of the procedure and terms for the transfer by a serviceman of the original personal order in case of capture to the commander of a military unit, commander/head of a unit of a body (service, military formation) for storage in his personal file;
introduction of a new order of priority of payment of financial support in equal shares, in the absence of such an order of the serviceman, namely: first of all – to the wife (husband), legal representatives of young (minor) children (persons with disabilities from childhood – regardless of their age) and parents of servicemen (except for children, parents and other persons receiving alimony from the serviceman, as well as parents deprived of parental rights, provided that such rights have not been restored);
in the second place (in the absence of representatives from the first place) – to adult children, siblings whose legal representative is a serviceman, in a total amount not exceeding 20 percent.
In case of death of a serviceman or recognition by a court of his death, the unpaid amounts of financial support are paid to the family members of the deceased servicemen referred to in the fourth paragraph of this clause, and in case of their absence, they are included in the inheritance.
