Verkhovna Rada wants to cancel the IQ test for HACC judges – the results are disastrous

On November 14, the Verkhovna Rada Committee on Legal Policy recommended adopting draft law No. 11425-d in the second reading and as a whole. The document provides for a number of changes in the procedure for selecting candidates for judicial positions, including the abolition of complex cognitive testing for candidates for appellate courts and the High Anti-Corruption Court (HACC). Main changes in testing

on October 29, the Verkhovna Rada passed the bill in the first reading. Its key innovation is the abolition of the mandatory requirement of a 75% passing score in cognitive testing. Instead, the High Qualification Commission of Judges (HQCJ) will set the passing level for this stage independently. This decision was made due to serious technical difficulties that arose during the IQ tests.

At the same time, even in the absence of technical problems, the results of the preliminary testing of candidates were recognized as “catastrophic”. According to the HQCJ, out of 124 candidates who took the cognitive test, only 22 people successfully coped with the task, which is 17.7% of the total number of participants.

New rules for competitions

The draft law stipulates that competitions to the appellate courts will be held according to updated rules. Participants in future competitions to local courts will be able to choose a specialization for the exam.

Also, the mandatory exam on the history of Ukrainian statehood for candidates participating in the current competitions to the appellate courts and the HACC is excluded from the test. This provision allows the HQCJ to reduce the burden on the candidates and, if necessary, to take their time with certain procedures.
