The government plans to amend the parameters for reserving citizens liable for military service from mobilisation. The Cabinet of Ministers is currently working with business and military experts on changes that will be implemented in the near future. This was stated by Prime Minister Denys Shmyhal during a press conference, Komersant ukrainskyi reports.
Shmyhal said that the changes are planned to be made to existing resolutions.
According to him, the government pays great attention to ensuring that the issue of fairness is respected.
“There should be very fair, transparent, clear rules for reservations and an answer as to why a reserved employee in a particular position does not go to war. We are currently finalising all these things with the military, and I think we will introduce them in the near future. It will not be something sensational, obviously, there will be changes to the existing booking parameters for Ukrainians,” the Prime Minister announced.
According to him, it is a matter of the “fight or flight” principle, which involves improving this approach.
According to Shmyhal, there is no need to develop separate legislation for this.
The Prime Minister stressed that today there are a number of parameters for economic reservation that relate to critical enterprises that ensure the vital activity of the state. These include the absence of tax arrears or the level of tax payment, the average salary in the industry and at the enterprise.
Criteria for enterprises critical to the economy
Cabinet of Ministers Resolution No. 76 sets out the criteria by which an enterprise is recognised as critical to the functioning of the economy and the livelihoods of the population during a special period:
- the total amount of taxes paid exceeds the equivalent of EUR 1.5 million;
- the amount of foreign currency revenues exceeds the equivalent of EUR 32 million;
- the company is of strategic importance for the economy and security of the state according to the list;
- the enterprise is important for a sector of the national economy or for meeting the needs of the territorial community;
- no arrears in the payment of a single contribution to the obligatory state social insurance;
- the average salary of insured employees at the enterprise for the last calendar quarter is not less than the average salary in the region for the fourth quarter of 2021;
- the company is a resident of Diia City.
An enterprise is recognised as critical if it meets at least two criteria. Such enterprises can book 50% of their employees, or more “in case of a reasonable need”.
The government has also approved a list of NGOs that have received 100% reservation from mobilisation.
