Passenger car drivers have been granted the right to drive trucks, but there is a nuance

Drivers with category B can drive C and C1 vehicles during martial law. The decision was made by the Kyiv Court of Appeal, Komersant ukrainskyi reports, citing the Judicial and Legal Newspaper.

The Kyiv Court of Appeal made this decision when considering an appeal against the decision of the Desnianskyi District Court of Kyiv of October 9, 2024.

This document convicted a man who was driving a Volkswagen T46 on August 13, 2024. The police drew up a report, noting that the driver did not have a license of the appropriate category. As a result, the driver was found guilty of violating Part 5 of Article 126 of the Code of Ukraine on Administrative Offenses (Driving a vehicle by a person who does not have or has not presented for inspection a driver’s license of the appropriate category, a registration document for a vehicle – ed.) The man was fined 2,400 (40,800 UAH – ed.) tax-free minimum incomes. He was also banned from driving vehicles for 5 years.

When considering the case, the court noted that in the report on the commission of an administrative offense, police officers did not specify what category of driver’s license the driver was supposed to have. Moreover, he had a valid category B driver’s license.

As a result, the complaint of the driver’s lawyer, who was found guilty of the violation, was upheld. The decision of the Desnianskyi District Court was canceled. Thus, the court confirmed that drivers with a category B license, which entitles them to drive cars weighing up to 3.5 tons, have the right to drive trucks up to and over 7.5 tons. However, this right is valid only until the martial law in Ukraine is lifted.
