The Supreme Court has upheld the position of the State Audit Service of Ukraine on the termination of a UAH 1.311 billion tender contract with the contractor for the reconstruction of the M6 Kyiv-Chop motorway, Komersant ukrainskyi reports, citing the press service of the State Audit Service.
As part of the monitoring of procurement in the Prozorro electronic trading system, auditors checked the legality of the tender held by the Road Service in Zakarpattia region and the selection of the winner.
During the audit, the State Audit Service found violations in the tender documentation of the winner, SBU-77 LLC.
“The private enterprise was unable to document the availability of the necessary equipment for the repair, so it was recommended that the Road Service in Zakarpattia region cancel the billion-dollar tender. Instead, the officials tried to challenge the auditors’ decision in court, but the Supreme Court upheld the position of the State Audit Service and left the decision in force,” the statement said.
The State Audit Service instructed the customer to eliminate all violations identified during the monitoring, insisting on the termination of the procurement contract.
According to media reports, SBU-77 LLC is owned by Andrii Bilous, a resident of Brovary, and the company is also registered in Brovary, Kyiv region, although it moved to Zakarpattia in 2021. It has traditionally been considered a favourite of road services in Zakarpattia and Chernivtsi regions.
