Ukraine will have a register of terrorist organizations: who will be included in it
7 January 21:46Ukrainian President Volodymyr Zelenskyy on 7 January signed a law on the formation of a list of terrorist organizations. This was reported by Komersant ukrainskyi with a reference to the law card on the website of the Ukrainian parliament.
We are talking about the bill № 12102 from 08.10.2024, initiated at one time by a group of MPs. Among them are Solomiya Bobrovska, Fedor Venislavsky, Yuriy Mysyagin, Sofia Fedina, Maryana Bezuglaya and others.
Parliament voted for this law on December 18, 2024.
What the document says
The purpose of this law the group of authors determined the establishment of a legally defined mechanism for inclusion of an organization (group) in the list of terrorist organizations (groups), regulation of the procedure and determination of the grounds for inclusion and exclusion of organizations (groups) in / from this list.
They noted that the development of the draft law is conditioned by the need to strengthen the institutional capacity of Ukraine in countering terrorist activities by introducing at the legislative level an algorithm for forming a public list of terrorist organizations (groups), regulating the procedure and determining the grounds for inclusion and exclusion of organizations (groups) in/from this list. After all, the results of the analysis of the current legislation of Ukraine indicate the lack of systematic legal regulation of the procedure for recognizing an organization (group) as a terrorist one, which does not allow taking effective measures of legal response to illegal activities, in particular, of international terrorist organizations.
The document provides for:
- amendments to Article 24 of the Law of Ukraine “On the Security Service of Ukraine”, establishing the duties of the SBU to form and maintain a list of terrorist organizations (groups) in accordance with the Law of Ukraine “On Combating Terrorism.
- the need to set forth Article 24 of the Law of Ukraine “On Combating Terrorism” in a new wording introducing the list of terrorist organizations (groups), the procedure for inclusion/exclusion of such organizations (groups) in/from the list, and the introduction of provisions on the formation of the list of terrorist organizations (groups);
- amendments to Article 24 of the Law of Ukraine “On Prevention and Counteraction to Legalization (Laundering) of Proceeds of Crime, Financing of Terrorism and Financing of Proliferation of Weapons of Mass Destruction” in terms of supplementing the grounds for inclusion/exclusion of a person in the list of persons associated with terrorist activities or subject to international sanctions;
- deletion of paragraph 3 of section II, paragraph 3, “Final and Transitional Provisions” of the Law of Ukraine “On Amendments to the Criminal Code and the Code of Criminal Procedure in connection with the ratification of the Additional Protocol to the Council of Europe Convention on the Prevention of Terrorism and to certain legislative acts of Ukraine concerning the improvement of the fight against terrorism” in order to bring the provisions of the current legislation into line with the proposed norms.
