New rules for registration of inventions in Ukraine: what has changed
5 November 04:05Ukraine has adopted European standards for registering inventions and utility models. This is reported on the government portal, Komersant ukrainskyi informs
The changes are intended to make the innovation registration procedure faster, more transparent and convenient for Ukrainian and foreign inventors.
The new rules comply with EU standards and take into account the provisions of the Acquis communautaire. They also take into account Ukrainian sanctions legislation: applications are checked for compliance with sanctions regulations.
Priority in reviewing applications is given to such industries as green energy, transportation technologies, nanotechnology, biotechnology, and defense.
In addition, the digitalization of examination will significantly reduce the time required to obtain rights to inventions and utility models.
Key changes in the registration procedure
The updated rules clearly regulate the rights and obligations of applicants, the list of required documents and the examination process. Particular attention is paid to international applications, applications in classified fields, the possibility of partial waiver of rights, and new mechanisms for comments and objections from third parties.
Requirements for inventions and utility models
According to the new rules, an invention or utility model is a new technical solution that can solve urgent problems in various industries.
To register an invention, it is important that it meets the requirements of industrial applicability and inventive step.
Utility models must meet the requirements of novelty and applicability.
European integration standards and sanctions restrictions
The updated rules are in line with European standards and take into account the provisions of the Acquis communautaire, which facilitates Ukraine’s integration into the European innovation community.
In addition, they comply with Ukrainian sanctions legislation: submitted applications are checked for compliance with sanctions regulations, and in case of sanctions, the application is considered subject to restrictions determined by the National Security and Defense Council of Ukraine.

“The new rules will allow us to digitize the process of examination of applications and, accordingly, speed up the registration of rights.
