Driver punished for ignoring military registration for the first time in Ukraine: what is known

Ukraine has recorded the first case of a person being restricted from driving a car because of a violation of military registration rules. This is reported by “Opendatabot”, Komersant ukrainskyi informs.

It is noted that at least 41 court cases related to the restriction of the right to drive a car due to violation of the rules of military registration were found using the search engine on the court register “Grandmother”.

Courts return cases back

According to analysts, in most cases, the courts are now returning the cases back, but this is only due to problems in filing claims, in particular, non-payment of court fees by the TCC.

“As state bodies, the CCCs could simply not have budgeted for the payment of court fees for such claims, as the mobilization legislation was amended in mid-2024,” comments lawyer Valentyna Slobodianiuk.

She notes that this situation is temporary, so in 2025 such an expense item should appear in the budgets of the CCCs, and accordingly, the chances of success in courts will increase.

Driver’s driving privileges restricted for the first time

However, according to analysts, there is already a case where the court has upheld the TCC’s claim. on January 22, for the first time, a driver was temporarily restricted from driving for violating the rules of military registration until he fulfills the requirements of the TCC or until this requirement is withdrawn.

Slobodianiuk emphasizes that restrictions on driving are not a novelty for Ukrainians. For example, such a measure of influence is actively practiced by public and private enforcement officers against alimony debtors.

In addition, lawmakers are planning to close access to information about court cases related to mobilization. The relevant draft law has already passed the first reading in the Verkhovna Rada and is being prepared for the second reading.

Thus, Ukrainians can only find out whether they have such lawsuits against them through the court services in the Diia app or in the electronic cabinet of the Yesud system.

As you know, on October 1, 2023, military registration became mandatory in Ukraine for women of certain professions aged 18 to 60. In order to avoid a fine, women had to register by July 17, 2024.

What violations are punishable by the MCC?

You can be fined, for example, for:

  • refusal to appear at the TCC for registration;
  • ignoring the summons to clarify the data;
  • evading the summons itself.

What are the fines for violators?

The fine for violation of the rules of military registration: in peacetime – from UAH 3,400 to 5,100; in a special period (including martial law) – from UAH 17,000 to 25,500. The fine must be paid by the violator no later than 15 days after the date of delivery of the resolution imposing the fine. In case of non-payment within this time, the fine order is sent for enforcement to the enforcement service at the place of residence, work or location of the violator’s property.

How can someone who fails to pay a fine be punished?

Debtors are subject to a number of restrictions, such as opening new bank accounts, blocking current ones, not being able to register various transactions through notaries, etc. At the same time, such penalties also have image implications, as the register is public, and therefore the information in it can be checked, in particular, by employers when hiring.
