Ukrainians will register property rights in a new way: what has changed

Ukraine has launched an automatic system for registering real estate ownership. Now the rights are registered without the participation of a state registrar. This is reported by Komersant ukrainskyiKomersant Ukrainian with reference to the Ministry of Community and Territorial Development of Ukraine.

The new service allows the State Register of Real Property Rights (SRRR) to receive information from the Unified State Electronic System in the Field of Construction (USESC) on the commissioning of completed construction objects for which the SRRR has registered a special property right (SPR):

  • divisible objects of unfinished construction (house);
  • future real estate objects (apartments, parking spaces, other premises);
  • registered SIP or ownership of indivisible objects of unfinished construction (garden/residential/cottage houses, etc.).

The Ministry explained that the functionality allows for simultaneous automatic updating of the technical characteristics of such real estate objects by amending the relevant sections, registering the ownership right instead of the previously registered SMP.

“This also occurs in cases provided for by law, registration of encumbrances, entering information on the joint ownership of owners of apartments and/or non-residential premises for such real estate, performing other registration actions and on the basis of information received from the USSSR,” the Ministry of Development added.

Moreover, the Ministry reported that the first registrations under the new functionality have already taken place. Its introduction

  • expands the list of administrative services provided in an automatic mode, which simplifies and improves the quality of their provision, as well as reduces the burden on state registrars
  • increases the degree of protection of the rights of persons to real estate (as it excludes the possibility of state registration on the basis of falsified documents that may be submitted to the state registrar).

“Automation of state registration processes allows individuals and legal entities to receive a comprehensive service in an automatic mode to carry out automatic registration actions in the State Register of Rights to Real Estate from the very beginning of construction and upon its completion,” the Ministry of Communities and Territories Development of Ukraine emphasized.
