The Cabinet of Ministers explained how to book an employee after December 1

On December 1, Ukraine will resume reserving employees of critical enterprises from mobilization. This was announced by Deputy Prime Minister, Minister of Digital Transformation Mykhailo Fedorov on Telegram, according to [Kommersant]

According to him, the booking option was previously available through Diia and offline. But from December 1, it will be available only online, which will solve the problem of long processing of documents.

“Companies that have retained their criticality status during the audit must update it by February 28. They will be able to book people as early as December 1, but the booking will only work until February 28,” said Fedorov.

According to him, new employees will be able to be booked immediately, no notice period is required. But the employee’s salary must be more than 20 thousand hryvnias. This rule does not apply to state and municipal enterprises, as well as Diia.City residents.

According to the new rules, in order to book people, a company must meet the following criteria

  • the average salary at the company is at least 20 thousand hryvnias
  • no tax debts;
  • one criterion from the list: residency in Diia.City; €1.5 million in taxes paid per year; €32 million in revenues or importance for the national economy or the needs of the local community.

To obtain or confirm the criticality, it is necessary to collect a package of documents confirming compliance with the criteria and submit them to the relevant government agency.

“Do you work in the energy sector? Apply to the Ministry of Energy. Are you engaged in agriculture? Go to the Ministry of Agriculture. Resident of Diia.City – to the Ministry of Digital Transformation. If you pay more than EUR 1.5 million in taxes per year, EUR 32 million in revenues or are important for the national economy, you should report to the Ministry of Economy,” Fedorov said.

As reported by [Kommersant] the new booking procedure will be effective from December 1, and for all those who already have deferrals, there will be a transition period to the new conditions until February 28.

Deferrals will be canceled in case of:

  • expiration of their validity period;
  • the enterprise, institution, organization completes the production of goods, performance of works and provision of services to meet the needs of the Armed Forces and other military formations;
  • deprivation of an enterprise, institution or organization of the status of critical for the functioning of the economy and ensuring the vital activity of the population during a special period by the body that made the decision to determine such enterprises, institutions and organizations as critical for the functioning of the economy and ensuring the vital activity of the population during a special period;
  • liquidation of a state authority, other state body, local self-government body, enterprise, institution or organization;
  • dismissal of a person liable for military service from a state authority, other state body, local self-government body, enterprise, institution or organization (except for dismissal with subsequent appointment to another position within the same state authority, other state body, local self-government body, enterprise, institution or organization);
  • temporary termination of the employment contract of a person liable for military service with an enterprise, institution or organization;
  • a substantiated request from the head of a state authority, other state body, local self-government body, enterprise, institution or organization;
  • granting a deferral for other reasons specified in Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization”;
  • termination of the concluded agreement (contract) or expiration of the term of appointment – for employees of specialized UN agencies, international judicial bodies, international and non-governmental organizations and institutions, where Ukraine is a member, participant or observer in accordance with the international agreements concluded by Ukraine;
  • failure of the mine action operator to carry out demining (humanitarian demining) works within six months according to a certified process (processes) based on information provided by the Mine Action Center.
