Diia has updated the rules for booking employees: what has changed

The state portal “Diia” has changed the scheme for calculating the number of employees of enterprises that can be reserved from mobilization. This was reported by the press service of the Ministry of Digital Transformation, "Komersant Ukrainian" informs

The right to be reserved from mobilization

As you know, the Ministry of Economy grants the right to reserve employees liable for military service under certain conditions. It is provided if companies are recognized as critical to the functioning of the state and the Defense Forces.

The fact of reservation allows companies to provide deferral of military service for their employees.

In particular, the deferral is subject to cancellation in the event of:

  • expiration of its validity period;
  • the company completes the production of goods, performance of works or provision of services to meet the needs of the Armed Forces;
  • deprivation of the enterprise of its critical importance status.

What has changed

The number of employees officially mobilized after May 18, 2024, was added to the number of persons liable for military service. Thus, the company will be able to book a larger number of specialists according to its percentage.

Before: only those who are registered with the military and not mobilized were taken into account.

Now: mobilized persons are added if they are officially employed.

For example: there were 80 people liable for military service – 40 were booked. 20 mobilized persons were added – the total number increased to 100 – now the limit for all employees increases to 50.

In addition, employees who already have a reservation in another company are no longer included in the total number of persons liable for military service.

How to book employees through Diia: step-by-step instructions

To book employees on the Diia portal, the company must have a valid critical enterprise status.

Who can get the status of a critical enterprise?

To obtain critical enterprise status, companies must meet three main criteria:

  • The average salary of employees is at least UAH 20,000.
  • No tax and unified social contribution arrears.

And one of the following criteria to choose from:

  • Large tax revenues: tax payments of more than EUR 1.5 million per year.
  • Foreign exchange earnings: more than EUR 32 million per year (excluding loans and credits).
  • Strategic importance for the state or importance for a particular industry or community.
  • Salary level: for utilities, it should not be lower than the average for the region for the last quarter of 2021.
  • Resident of Diia.City.
  • Provider of electronic communication services: these are companies operating in mobile networks (net income over UAH 200 million/month) or fixed networks (net income over UAH 20 million/month).

Send an official letter to the executive authorities or military administrations with justifications for meeting the criteria and get the criticality status.

How to submit a booking request through Diia

To book employees, you need to follow a few simple steps:

  • Log in to the Diia portal, select the Employee booking service, and click Submit application.
  • Enter the details of the employees you plan to book.
  • Confirm the employee’s salary.
  • Check the accuracy of the entered data and sign the application. The signature is to be made by the head of the company or an authorized person.

The result will be sent to your e-mail and to your account on the Diia portal. If the reservation is successful, it will be displayed in the Employee Pool system.

How to solve the problem with the absence of employees in the registers

If a new employee is not reflected in the registers, contact the Pension Fund of Ukraine (PFU) to update the data. Do this through the Communications with the Pension Fund section of the portal: use the prompt notification* on labor relations – instructions here.

*Submit the prompt notification immediately after hiring, dismissing, or transferring an employee – the same day or the next day.

If you submit the employee’s data on time, the employee will be displayed in the Oberig system and the booking will go smoothly. However, if the information was sent with a delay, submit the Tax calculation through the STS portal for the last reporting period and wait until the Pension Fund updates the information in the register.

Who has the right to book up to 100% of employees?

  • For some businesses, it is possible to book up to 100% of their employees. This applies to:
  • Enterprises of the fuel and energy complex (by decision of the Ministry of Energy).
  • Companies that perform the functions of the technical administrator of the Diia Portal.
  • Enterprises of the defense industry (by decision of the Ministry of Strategic Industries).
  • Enterprises that include full-time national teams of Olympic, non-Olympic sports and sports of persons with disabilities (by decision of the Ministry of Youth and Sports).
  • Specialized UN agencies, foreign diplomatic missions, representative offices of international organizations (by decision of the Ministry of Foreign Affairs).
  • Specialized UN agencies, international judicial bodies, international or non-governmental organizations and institutions of which Ukraine is a member, participant or observer.

There are also categories of employees who can be booked outside the company’s limit, namely

  • Medical workers for whom work in healthcare facilities is the main job.
  • Employees of emergency repair teams that ensure the operation of electronic communication networks.
  • Employees of teams engaged in the construction of blackout-resistant electronic communication networks (using xPON technology) or mobile communication networks.
  • Employees of emergency repair teams that ensure the operation of gas distribution systems.

This way, companies will work for the economy and defense without interruptions for paperwork.
