The High Council of Justice has dismissed Makariv District Court judge Oleksiy Tandyr, who is accused of a fatal road accident. This was reported by Komersant ukrainskyi with reference to the press service of the High Council of Justice.
The reason for the dismissal is “committing a significant disciplinary offence”, which is incompatible with the status of a judge.
“On 6 August 2024, the HCJ decided to dismiss judge Oleksiy Tandyr of the Makariv District Court of Kyiv Region on the basis of paragraph 3 of part six of Article 126 of the Constitution of Ukraine,” the statement said.
Also today, the HCJ decided to dismiss Vsevolod Kniazev, a judge of the Administrative Court of Cassation within the Supreme Court.
What is known about the Tandir case?
On the night of 26 May 2023, Oleksii Tandyr, the head of the Makariv District Court of Kyiv Region, ran over a National Guard officer to his death at a checkpoint in the capital.
The deceased National Guard officer, Vadym Bondarenko, was 23 years old. He is survived by three children.
The law enforcement officers who detained Tandyr noted that the man had visual clinical signs of intoxication, but refused to be tested for alcohol and drugs in his body. Subsequently, biological samples were forcibly taken from Tandir.
The results were not available for about a month, but a forensic psychological examination confirmed that Tandyr was drunk at the time of the accident.
In August, the SBI completed the investigation into Tandyr. Experts conducted 18 examinations, which confirmed the alcohol content in the ex-judge’s samples.
The SBI said that Tandyr, who had experience in road accident cases, tried to hide his intoxication by distorting the contents of the samples. It was reported that instead of urine, Judge Oleksiy Tandyr submitted water and saliva for analysis, thus attempting to falsify the examination.
The judge is accused of violating road safety rules while intoxicated, which caused the victim’s death (Part 3 of Article 286-1 of the Criminal Code of Ukraine).
In August 2023, the pre-trial investigation against the judge was completed, and the case is pending in court.
In May, the measure of restraint was extended for judge Oleksii Tandyr. He will be held in custody until 21 July without the possibility of bail.
Recently, Tandyr made an unsuccessful attempt to be mobilised, joining the military service in Chernihiv.
