SAPO sends case involving Odesa mayor to court
6 December 02:21The NABU and the SAPO have sent to court a case against a criminal organization whose activities caused UAH 689 million in damage to the local community of Odesa. There are 11 defendants in the case, including the current mayor of Odesa, Hennadiy Trukhanov. This was reported by Komersant ukrainskyi with reference to the SAPO press service.
The defendants are:
- mayor of Odesa;
- director of the Legal Department of the Odesa City Council;
- the former head of the communal property department of the Odesa City Council and his deputy;
- a deputy of the Odesa City Council of the 7th convocation – chairman of the Standing Committee on Communal Property;
- another city council deputy – chairman of the standing committee on land management and land relations of the city council and assistant to the mayor of Odesa;
- other persons and members of the criminal organization are private individuals.
The SAPO noted that, according to the investigation, during 2016-2019, the offenders developed a criminal scheme for the illegal transfer of land plots for their further development.
For example, land plots in Odesa were leased out bypassing the tender exclusively to pre-agreed development companies. The developers paid money or transferred property (apartments, non-residential premises) to the criminals, who, through their controlled persons in the Odesa City Council, ensured that the relevant decision to lease the land was made.
The total amount of damage caused by these episodes, according to the results of the examination, is UAH 689 million.
In addition, the facts of legalization of funds received by the criminal organization from committing other criminal offenses were established. The actions of the persons are qualified on the grounds of crimes stipulated by Part 1 Art. 255, Part 4 Art. 28, Part 2 Art. 364, Part 5 Art. 191, Part 3 Art. 209, Part 4 Art. 368, Part 3 Art. 369, Part 1, 2 Art. 369-2 of the Criminal Code of Ukraine.
The actions of the head of the criminal organization, who is hiding from the investigation outside Ukraine, are qualified under Part 1 of Art. 255, Part 3 of Art. 27, Part 4 of Art. 28, Part 5 of Art. 191, Part 3 of Art. 27, Part 4 of Art. 28, Part 2 of Art. 364, Part 3 of Art. 27, Part 3 of Art. 209, Part 3 of Art. 369, Part 2 of Art. 369-2, Part 1 of Art. 369-2 of the Criminal Code of Ukraine.
