Tax authorities are ordered to comply with court decisions without delay

During a meeting with business in Zhytomyr region, the head of the State Tax Service of Ukraine Ruslan Kravchenko instructed his subordinates to comply with court decisions as soon as they come into force. This was reported by the State Tax Service, Komersant ukrainskyi reports.

More than 50 representatives of large, medium, and small businesses and their associations joined the conversation with the State Tax Service leadership.

The State Tax Service called it “a new format of open dialog between the State Tax Service and entrepreneurs.” Similar meetings with businesses and their associations will reportedly be held in all regions of the country.

According to Ruslan Kravchenko, non-enforcement of court decisions is a painful issue for business.

“I am sure that litigation should be a last resort. All disputes should be resolved immediately. As for the enforcement of court decisions. I gave a clear order to execute court decisions immediately after they come into force,” Ruslan Kravchenko emphasized.

What other problems in relations with the State Tax Service concern entrepreneurs

The list of top issues that were also voiced during the meeting includes

– frequent changes in legislation,

– blocking of tax invoices,

– classification of enterprises as risky.

The Head of the State Tax Service agreed that business does not have time to adapt to changes in legislation and even cited data from the World Bank, according to which 52% of entrepreneurs consider constant changes in legislation to be a significant problem.

Ruslan Kravchenko said he had appealed to MPs to take this into account when developing new legislative initiatives.

The head of the State Tax Service also instructed the relevant departments of the State Tax Service to analyze in detail the situation with complaints about unreasonable decisions to block tax invoices and grant risky status to enterprises. According to him, the relevant commissions should promptly consider all requests for unblocking so that the work of companies is not blocked, but all this should be done exclusively within the framework of the law.

In this context, they also exchanged views on the anti-corruption component of the State Tax Service.

“Sometimes I hear that tax officers demand something from someone,” Ruslan Kravchenko said and advised entrepreneurs to avoid this by contacting law enforcement and writing statements to ensure that all facts are properly documented and the perpetrators are brought to justice.

At this meeting, the State Tax Service leadership also heard from entrepreneurs that “in times of war, business should not be divided into white and black, as each of them not only pays taxes but also creates jobs.” This is about the shortcomings in the implementation of the Territory of High Tax Confidence project. By the way, 209 taxpayers represent Zhytomyr region in the White Business Club.

What do both white and black businesses complain about?

In 2024, for example, the Business Ombudsman Council received a total of nearly 1,200 complaints from entrepreneurs. And most often they complain about tax issues – the number of such complaints last year reached 55 percent.

The following problems in relations with the tax authorities consistently hold the top four spots in the ranking of complaints

– failure to comply with court decisions on the registration of tax invoices,

– inclusion in the list of risky taxpayers,

– tax audits themselves,

– systematic blocking of tax invoices.

In addition to the above, VAT administration remains a problem for a significant number of entrepreneurs. Businesses are dissatisfied with the process of appealing tax claims for payment/repayment of tax debt, revocation of licenses for wholesale fuel trade, correction of information in the integrated taxpayer card, and renewal of single tax payer registration.
