Drunk driving: Mustafa Nayem was fined and deprived of his license

Mustafa Nayem, the former head of the State Agency for Infrastructure Restoration and Development, was fined and banned from driving for a year. The decision was made by the Pechersk District Court of Kyiv, having considered an administrative case regarding an incident that occurred in the spring of 2024. This is evidenced by data from the Unified Court Register, according to [Kommersant]

What happened?

on May 30, 2024, during a curfew in Kyiv, Mustafa Nayem, who at the time held the position of head of the State Agency for the Restoration and Development of Infrastructure, was stopped by patrol police on Mykola Mikhnovsky Boulevard. He was driving a BMW while being drunk. The police dashcam recorded Nayyem being offered to take a breathalyzer test using a Drager device.

Initially, Nayyem failed to pass the test several times due to insufficient exhaled air volume, which led to an error of the device. However, after several attempts, the test showed a result of 0.62 ppm, which exceeds the permissible limit. The police notified Nayem that an administrative report was drawn up under Article 130(1) of the Code of Administrative Offenses (CAO) and banned him from driving.

“Nayem said he pleaded guilty. He refused the offer to be examined at the Sociotherapy medical institution, saying that he trusted the patrol officers and the results of the device,” the case file says.

The police drew up an administrative report against the official under Part 1 of Article 130 of the Code of Administrative Offenses (driving while intoxicated). Nayyem pleaded guilty, did not deny the actions of the patrol officers, and refused to undergo a second medical examination, noting that he trusted the results of the Drager.

Court decision

on May 13, 2025, the Pechersk District Court of Kyiv found Mustafa Nayem guilty of violating traffic rules.

The court ordered

  • afine of UAH 17,000;
  • deprivation of the right to drive vehicles for a period of 1 year.

At the time of the ruling, Nayem was no longer in office – he submitted his resignation on June 10, 2024, 11 days after the incident.

It should be noted that in April [Kommersant] reported that a decision had been made at the highest political level to dismiss Mustafa-Masi Nayem, the head of the State Agency for the Restoration and Development of Infrastructure of Ukraine, from his post.

Questions about the work of the State Agency for the Restoration and Development of Infrastructure of Ukraine, headed by Mustafa Nayem, have been raised after the Russians destroyed the Trypillia thermal power plant in Kyiv region in a massive attack with missiles and drones on the night of April 11, and Centrenergo lost all 100% of its generation. The State Agency for the Restoration and Development of Infrastructure is partially responsible for security at Ukrainian energy facilities.

However, the agency reported that it is building protective structures for 22 Ukrenergo power substations. The agency is not involved in the construction of protective structures at Centrenergo’s facilities, including the Tripillya TPP.

Mustafa Nayem wrote a letter of resignation on June 10, 2024. The reason for his resignation was “systemic obstacles that do not allow him to fulfill his duties effectively”. Another reason he gave was that since the beginning of the year, the Agency has been significantly cut in salaries – most employees have had their salaries cut by up to 68%.

Earlier, Nayem complained that salaries at the Recovery Agency were too low.
