Educational institutions are preparing for inspections: The Cabinet of Ministers has changed the rules

The government has again allowed inspections in the education sector. The Cabinet of Ministers of Ukraine made the decision by amending Resolution No. 303 of March 13, 2022, which previously restricted state supervision during martial law, Komersant ukrainskyi reports

According to the updated resolution, clause 44 stipulates that restrictions on inspections no longer apply to the education sector:

“To establish that the effect of paragraphs 1 and 2 of this resolution does not apply to planned, unscheduled measures of state supervision (control) in the field of education.”

This means that inspections in schools, kindergartens, universities and other educational institutions will be resumed in full, both scheduled and unscheduled.

When and why can they be inspected

According to clause 5 of Article 69 of the Law of Ukraine “On Education”, an unscheduled inspection may be initiated by

  • an individual who files a complaint;
  • the Educational Ombudsman (Commissioner for the Protection of Rights in Education).

Scheduled inspections, in turn, are conducted in accordance with approved schedules and are aimed at systematic monitoring of the activities of educational institutions.

Such inspections are aimed at identifying violations and shortcomings in the work of educational institutions and protecting the rights of pupils, students, and teachers.

How educators react

The decision to resume inspections has caused a mixed reaction in the educational environment. Social media actively commented on the news, expressing both sarcasm and concern.

“Like raising salaries – in all spheres, but not in education, because of martial law. As for supervision and inspections – only in education, they will be restored, because martial law does not concern you!”, “We, educators, are the best! We are fully trusted! It’s very nice! The restoration of inspections in the standard version is a sign of quality!”, “Give us more inspections!) For all educators! Every day a new inspection!”, “And we somehow did not notice that there were no inspections for three years… It’s amazing…”, – written in the comments.

These comments reflect the frustration of some educators who believe that inspections add bureaucratic pressure without adequate support, such as higher salaries or better working conditions.

It should be reminded that according to paragraph 1 of Resolution No. 303, scheduled and unscheduled state supervision (control) measures are not carried out during martial law.

Clause 2 of Resolution No. 303 allows for unscheduled state supervision (control) measures based on decisions of central executive authorities that ensure the formation of state policy in the relevant areas only if there is a threat that has a negative impact on the rights, legitimate interests, human life and health, environmental protection and state security, as well as to fulfill Ukraine’s international obligations during martial law.
