The Ombudsman told under what conditions he would support the new draft law on mobilisation

The Ukrainian Parliament Commissioner for Human Rights, Dmytro Lubinets, said that the Ministry of Defence is currently consulting him on a new draft law on mobilisation, which was not the case before. He said this during a telethon, reports комерсант

According to the Ombudsman, the Ministry of Defence seems to be ready to take into account some of his comments.

“I have not seen the final version. Unlike the previous version, the group working in the Ministry of Defence is now seeking the expert opinion of the Ukrainian Parliament Commissioner for Human Rights. We have provided our categorical objections to the mobilisation of citizens with disabilities of the third category. As far as I know, their preliminary position is that they are ready to take this into account,”

– lubinets said.

The Ombudsman also warns the Ministry of Defence against attempts to prescribe additional powers for the staff of the TCC in the draft law.

“Second, I am categorically against granting additional powers to territorial recruitment centres. These are military units. They have no right to restrict the rights of Ukrainian citizens. This is a direct violation of the Constitution, which I mentioned earlier. We have other bodies that can implement similar tools for people who refuse to perform military service. But this cannot be done by territorial recruitment centres,”

– insists the Ombudsman.

In general, he is ready to support the draft law if it complies with the Constitution of Ukraine.

“If this is taken into account, I will be ready to support the proposed version. We all understand that we, as a state, need a new draft law on mobilisation. But, again, I will study it carefully. If there are any contradictions with the Constitution of Ukraine, I will again be categorically against it,”
