MP faces criminal case for honoring fallen hero

Ukrainian MP Olha Vasylevska-Smagliuk is facing charges of “arbitrariness” for unauthorized installation of a portrait of a deceased soldier. The MP reported this on Facebook, according to Komersant ukrainskyi.

The MP claims that she also received a written refusal from the village council. Then she decided to act on her own.

“I ordered a metal structure and a portrait at my own expense, and my assistant consultant

According to her, after the portrait was installed, problems began:

“We caught up with lawyers, local council members, who suddenly started talking about the law, the grounds, etc. These are exactly the people who have a couple of criminal proceedings about illegal land allocations, who feel sorry for a meter of land for the deceased. He said goodbye to his life for this land, you bastards. So that his son, on his way to school, could pay tribute to his father and know that he did not die in vain. Not for these idiots and soulless creatures who have nothing sacred in them.”

Vasilevska-Smagliuk also emphasizes the legal absurdity of the situation:

“…in order for this article of the Criminal Code to be applied to me, there must be losses. What losses, if this village council even saved money?”

However, the son of the deceased soldier rightly saw his father on the Alley of Heroes.

The Polissia village council has not yet commented on the situation.

Article 356 of the Criminal Code of Ukraine provides for liability for “unauthorized, contrary to the procedure established by law, committing any actions, the legality of which is disputed by an individual citizen or an enterprise, institution or organization, if such actions caused significant damage to the interests of a citizen, state or public interests or the interests of the owner.”

Such actions are punishable by a fine of up to fifty tax-free minimum incomes, or correctional labor for up to two years, or probationary supervision for up to two years.
