MES accused of abuse of power: orders #1112 and #1276 may violate the law

The Verkhovna Rada Committee on Education, Science and Innovation has officially clarified:
The Ministry of Education and Science has no right to break the law – even during the war. This was reported in a telegram by MP Pavlo Sushko, "Komersant Ukrainian" reports.
What is the essence of the conflict?
The Ministry of Education and Science of Ukraine issued orders No. 1112 and No. 1276, which actually changed the procedure for obtaining education, in particular, the minimum number of students in classes.
However, this is a direct violation of the law, as this rule is clearly defined in the legislation, and no order of the Ministry of Education and Science has the right to change it.
What does the law say?
During martial law, the Ministry of Education and Science has the right to make operational decisions only within its competence – on security and the organization of education.
It is forbidden to exceed its authority.
What is the reaction of the parliament and the government?
- On the instructions of the Prime Minister, the Ministry of Justice has already considered a collective appeal from MPs to cancel these orders.
- on April 16, 2025, the Ministry of Justice sent an official appeal to the Ministry of Education and Science with a proposal to revise the orders.
- However, the Ministry of Education and Science has not yet taken any action.
What’s next?
The MPs have repeatedly appealed to the Minister of Justice Olha Stefanishyna and the Minister of Education Oksen Lisovyi to revise the order.
They are also preparing a meeting with the Prime Minister to finally resolve the situation.
MPs’ position: The Ministry of Education and Science is manipulating the legislation under the guise of caring about education, but in fact is trying to circumvent the law.
