Mobilization in Ukraine: who will not be subject to conscription in November 2024
4 November 09:52Ukraine continues to mobilize persons liable for military service in the Armed Forces. However, the current legislation of Ukraine defines several categories of persons who are not subject to military service. Who is not subject to mobilization during martial law
First of all, it should be noted that men under the age of 25 and over 60 are not mobilized in Ukraine. Men who have been declared unfit and excluded from military registration are also not subject to conscription. In addition, the mobilization of women into the Armed Forces is exclusively voluntary.
Following the amendments to the mobilization procedure that came into force on May 18, 2024, persons entering postgraduate studies are now also eligible for a deferment from conscription.
At the same time, men aged 18 and older, as well as women with medical specialties, must be registered with the military. Instead, men aged 17 need to come to the CCC and JV to get a military ID card.

Who is eligible for a draft deferment?
The categories of persons eligible for a draft deferment include those who cannot perform military service due to the following circumstances.
Unfit for health reasons
Persons with disabilities of I-III degrees or those who have been declared unfit for military service cannot be mobilized.
Presence of a number of family circumstances
Not subject to mobilization:
- Persons with three or more dependent children under the age of 18.
- A single father or a single mother raising a child or children under the age of 18 on their own.
- Persons who are guardians, custodians, foster parents or foster parents and are raising a child with a disability of subgroup A under the age of 18 or a child with a disability.
- Persons supporting an adult child aged 18-23 with a disability of group I or II.
- Persons who are adoptive parents, guardians, foster parents or foster parents of orphans or children deprived of parental care under the age of 18.
- Persons who provide full-time care for their spouse, child, or their own parents or the other spouse’s parents, if they need care.
- Persons who have a spouse with a disability or one of the parents of both parties with a disability of group I or II.
- Guardians of a person with a disability who has been recognized as incapacitated, or persons who care for a person with a disability of group I or II or a person in need of constant care (in the absence of other persons capable of providing care).
- One of the spouses, if both are in military service and have a minor child or children, as well as female military personnel during pregnancy.
- Persons whose close relatives were killed or went missing during the Russian-Ukrainian war. Close relatives include husband/wife, son/daughter, father/mother, grandparents or siblings.
Studying or teaching in higher education institutions
The following categories of men are not eligible for military service:
- Persons enrolled in vocational or vocational-technical education institutions, students of higher education institutions, participants in professional pre-university education programs, trainee assistants, postgraduate students and doctoral students (provided they are studying on a full-time or dual form).
- Scientific, scientific-pedagogical and pedagogical specialists who work in scientific institutions, higher education institutions, institutions of professional higher and vocational (vocational-technical) education or general secondary education at the main place of work at least 0.75 times, regardless of academic degree or title.
Engagement in certain types of activities
Not subject to mobilization:
- Persons working in government agencies, as well as in critical enterprises and organizations.
- Members of the Verkhovna Rada of Ukraine and members of the Parliament of the Autonomous Republic of Crimea.
Reservation of employees liable for military service
According to the updated law on mobilization, persons who have been reserved by the organization in which they work cannot be mobilized into the Armed Forces of Ukraine. More details on the criteria for such organizations and the reservation procedure can be found in Article 25 of the Law.
Dismissal of servicemen in the reserve
Persons who performed military service during mobilization and were discharged to the reserve (except for those enrolled in the first-line military operational reserve) are not subject to mobilization during partial mobilization within six months from the date of discharge from service.
Availability of a deferment for health reasons
Persons who have been granted a deferral for up to 6 months by a military qualification commission due to their health condition cannot be mobilized.
