TCCs will start using video recorders to record their actions. This was reported by Komersant ukrainskyi with reference to the Instruction on the use of technical devices and technical means with photo and video recording functions by the TCC.
It should be noted that on 16 September, the Ministry of Justice registered the order of the Ministry of Defence No. 532 of 6 August 2024 approving the instruction, but it has not yet entered into force.
According to the instruction, photo and video recordings from portable video recorders used by authorised representatives of the TCC (Territorial Centre for Recruitment, Collection and Training of Citizens for Military Service) may be provided to public authorities, law enforcement agencies, prosecutors, investigating judges and courts, police and other persons upon a reasoned request, in accordance with the law. These records may also be used in the media and distributed on the Internet with the permission of the Head of the TCC and in accordance with the Law on Personal Data Protection. The transfer of such recordings is carried out in order to ensure the safety and interests of citizens, society and the state, as well as to protect the honour and dignity of the TCC staff.
The use of portable video recorders is intended to prevent, detect or record violations of the rules of military registration by conscripts, persons liable for military service and reservists, as well as to record the actions of authorised representatives. Portable video recorder is a device that can be attached to the uniform of a representative of the CCC and is designed to record, store and play video information.
The authorised representatives of the SCC are prohibited from disclosing personal data obtained as a result of photo and video recording, except in cases provided for by law. The Head of the TCC shall appoint a responsible person who is responsible for the storage and issuance of portable video recorders, memory cards, recording of information received from video recorders, as well as maintaining the necessary documentation.
The portable video recorder shall be switched on at the beginning of the performance of official duties of the TCC representatives and shall be continuously recorded until the end of the performance of the events, except in certain cases. The authorised representatives are prohibited from deleting video recordings, changing the system date and time, stopping recording at the request of unauthorised persons, interfering with photo and video recording, using video recorders for purposes unrelated to the exercise of their powers, copying or transferring information to third parties.
In the event of loss or damage to a portable video recorder or memory card, an internal investigation will be conducted. Video recordings are uploaded from memory cards to a video storage server within the controlled area without a connection to global networks. The storage period of video recordings shall be determined in accordance with the applicable law.
The period of storage of video recordings may be extended by the decision of the Head of the TCC and JV in the following cases:
1) if they are used as a source of evidence in criminal proceedings and/or proceedings on administrative offences
2) when considering complaints against actions or omissions of authorised representatives in the exercise of their powers;
3) when providing information at the request of a lawyer or a law enforcement agency;
4) recording emergency events involving the personnel of the TCC and JV;
5) other events, if they can be used in the course of official activities of the TCC and JV, during official investigations.
Control over the use of technical devices with photo and video recording functions shall be exercised by the responsible person, and the information obtained with their help shall be verified by the head of the TCC and JV. The right to view, copy and transmit photo and video recordings is permitted only by the decision of the manager. Video recordings may be copied and transferred only upon written order of the Head of the TCC and JV or his/her deputy. Photos and video recordings or copies thereof may be provided to the authorities, investigation bodies, police and other persons in accordance with the procedure provided for by law. The distribution of photo and video recordings obtained from portable video recorders for use in the media, as well as on the Internet, must be subject to the permission of the Head of the TCC and JV and in compliance with the law on personal data protection. The Head of the TCC and JV conducts a selective online review of the photo and video recording materials to monitor the performance of duties.
