The Russian Maritime Register Network in Ukraine: How the HACC destroyed a part of Russian state-owned business

On Wednesday, March 5, the High Anti-Corruption Court partially satisfied the claim of the Ministry of Justice of Ukraine against the Russian Federal Autonomous Institution “Russian Maritime Register of Shipping”. This was reported by the Ministry of Justice and the press service of the HACC, Komersant ukrainskyi reports.

According to the court’s decision, the state imposed a sanction on the Russian institution under paragraph 1-1 of Part 1 of Article 4 of the Law of Ukraine “On Sanctions”, namely the recovery of assets to the state’s revenue.

Assets recovered for the benefit of Ukraine:

1. 100% of the total number of shares in the Private Joint Stock Company “Maritime Register of Shipping” (location: Sevastopol) in the amount of 1,000 shares with a nominal value of UAH 10,000, owned by the Federal Autonomous Institution “Russian Maritime Register of Shipping”;
2. 100% of shares of the total number of shares of the Private Joint Stock Company “Maritime Register of Shipping in Ukraine” (location: Odesa), in the amount of 1,000 shares with a nominal value of UAH 100,000, owned by the Federal Autonomous Institution “Russian Maritime Register of Shipping”;
3. 100% of the share of the authorized capital of the Limited Liability Company “Maritime Bureau of the Register” (location: Odesa), which in monetary terms amounts to UAH 100,000, owned by the Private Joint Stock Company “Maritime Register of Shipping in Ukraine”;
4. the right of creditors’ claims of the Federal Autonomous Institution “Russian Maritime Register of Shipping” to Joint Stock Company INTERNATIONAL RESERVE BANK in the amount of UAH 1,126,600.24;
5. the right of creditors’ claims of Private Joint Stock Company Maritime Register of Shipping in Ukraine to Joint Stock Company INTERNATIONAL RESERVE BANK in the amount of UAH 4,860.80;
6. the right of creditors’ claims of the Private Joint Stock Company “Maritime Register of Shipping in Ukraine” to the Joint Stock Company “BANK “FINANCE AND CREDIT” in the amount of UAH 11,772,267.63;
7. the right of creditors’ claims of the Private Joint Stock Company “Maritime Register of Shipping in Ukraine” to the Joint Stock Company “BANK “FINANCE AND CREDIT” in the amount of UAH 10,962.00;
8. funds in the amount of 14,963.76 Russian rubles placed on a bank account opened with Joint Stock Company JSB RADABANK belonging to Private Joint Stock Company Maritime Register of Shipping in Ukraine;
9. funds of the Private Joint Stock Company “Maritime Register of Shipping in Ukraine” in the amount of UAH 6,714,315.90, which were transferred to the management of the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes, credited and placed on the Agency’s deposit account opened with the Joint Stock Company “State Savings Bank of Ukraine”;
10. funds of the Private Joint Stock Company “Maritime Register of Shipping in Ukraine” in the amount of EUR 483,602.52, which were transferred to the management of the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes, credited and placed on the Agency’s deposit account opened with the State Savings Bank of Ukraine;
11. securities, namely domestic government loan bonds, which were purchased by the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes at the expense of the private joint-stock company “Maritime Register of Shipping in Ukraine” in the amount of 336 pieces with a nominal value of USD 1,000, and the rights to which are accounted for on the securities account of the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes, which is opened in
12. securities, namely domestic government bonds purchased by the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes at the expense of the private joint-stock company “Maritime Register of Shipping in Ukraine” in the amount of 3,017 pieces with a nominal value of EUR 1,000, and the rights to which are accounted for in the securities account of the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes, which is opened in the depot
13. premises with a total area of 107.6 sq.m. in Kherson, owned by the private joint-stock company Maritime Register of Shipping in Ukraine
14. non-residential premises with a total area of 337.3 sq.m. in Mykolaiv, owned by the Private Joint Stock Company “Maritime Register of Shipping in Ukraine”;
15. 33/100 shares in the right of joint fractional ownership of the household to the administrative building in Odesa with a total area of 5523.0 sq.m., land plot area of 4880 sq.m., unauthorized area of 29.9 sq.m., owned by the Private Joint Stock Company “Maritime Register of Shipping in Ukraine”;
16. an administrative building in Sevastopol with a total area of 1527.6 sq.m. owned by the private joint-stock company Maritime Register of Shipping in Ukraine;
17. 186/1000 shares in the right of joint partial ownership of an administrative building in Sevastopol with a total area of 680.2 square meters owned by the private joint-stock company “Maritime Register of Shipping”;
18. 584/1000 shares in the right of joint partial ownership of an administrative building in Sevastopol with a total area of 680.2 square meters, owned by the private joint-stock company “Maritime Register of Shipping”;
19. 45/1000 shares in the right of joint partial ownership of a non-residential building in Kerch, owned by the private joint-stock company “Maritime Register of Shipping”;
20. non-residential premises in Izmail with the area of 911.6 sq.m. owned by the private joint-stock company “Maritime Register of Shipping in Ukraine”;
21. eight cars owned by the Private Joint Stock Company “Maritime Register of Shipping in Ukraine” of the following brands: Skoda Octavia (3 pcs.), CHEVROLET LACETTI, MERCEDES-BENZ GL, MERCEDES-BENZ VITO, MERCEDES-BENZ 115D, GAZ.

The total amount of confiscated assets amounted to almost UAH 13 million, RUB 2.5 million and EUR 483 thousand. The total area of the confiscated real estate is almost 2 thousand square meters.

What is the Russian Maritime Register of Shipping?

The Russian Maritime Register of Shipping is the leading company in the Russian Federation in the shipping industry. The organization carries out classification of seagoing vessels, technical surveillance of them and issuance of necessary documents, certificates and acts, including for vessels of the Russian Navy. This institution also certifies floating structures, ship mechanisms, equipment and devices.

For some reason, subsidiaries of this Russian institution were registered and operated in the Ukrainian cities of Odesa and Sevastopol. In addition, the Russian Maritime Register of Shipping was actively involved in the implementation of all oil and gas projects of the Russian Federation.

Now the Ukrainian authorities have gotten their hands on it.

An appeal against a decision of the High Anti-Corruption Court may be filed with the Appeals Chamber of the High Anti-Corruption Court within five days of the announcement of the court’s decision.
