AFU commander faces 8 years for negligence in wartime: UAH 3.37 million in damages to defense

The State Bureau of Investigation has completed a pre-trial investigation into the former commander of a military unit responsible for fuel supply and maintenance of vehicles of the Armed Forces of Ukraine. His actions led to the loss of public funds worth more than UAH 3.37 million, "Komersant Ukrainian" reports, citing the SBI.

According to the investigation, the officer improperly fulfilled his official duties during the conclusion and implementation of a contract for the purchase of goods for defense needs under martial law. In particular, he did not take measures to exclude value added tax (VAT) from the contract price, which in such cases, according to the law, should be 0%.

Despite his official powers and the obligation to control the use of budget funds, the serviceman did not initiate changes to the contract, did not organize claim work and actually allowed the loss of public funds.

Although the damages were fully compensated, an indictment was filed against the serviceman under Article 425(4) of the Criminal Code of Ukraine – negligent attitude to military service that caused grave consequences under martial law.

The sanction of this article provides for punishment in the form of imprisonment for up to 8 years.

The case is being prosecuted by the Specialized Defense Prosecutor’s Office of the Prosecutor General’s Office.
