Who can get a reservation from mobilisation: criteria for defence companies updated

Ukraine has updated the criteria for determining defence industry enterprises that are used to book employees subject to military service for the period of mobilisation and wartime. This was reported by the citing the Ministry of Strategic Industries of Ukraine.

There are two booking options: from 50% of employees liable for military service and up to 50% inclusive.

Thecategory of 50% of employees, regardless of military speciality, includes enterprises, institutions and organisations that produce goods for the military, develop, upgrade and repair military and special equipment and spare parts, manufacture ammunition and other defence products.

They must meet both criteria:

  • The company must be in the process of fulfilling a contract with a government defence customer or be a co-executor of such a contract.
  • More than 50% of the total production volume is defence-related goods, works and services (for the last reporting period).

Thecategory of up to 50% of employees liable for military service (inclusive ) is intended for companies operating in the industrial, aircraft and space sectors.

They must meet three of the five criteria listed below:

  • The company must be in the process of fulfilling a contract with a state customer in the defence sector, or be a co-executor of such a contract.
  • More than 50% of the total production volume is defence-related goods, works and services (for the last reporting period).
  • The company must be included in the electronic register of participants in the selection and execution of state contracts (agreements) in accordance with the Law of Ukraine.
  • The company must participate in the implementation of tasks and activities envisaged by state target programmes in the aircraft industry and in the field of space activities;
  • The enterprise must manufacture goods, perform works and provide services for defence industry enterprises (which, in turn, use them to manufacture defence goods).

The decision on whether an enterprise meets these criteria is made by a working group formed by the Ministry of Strategic Industries and representatives of other interested state authorities.

New draft law on mobilisation

on 7 February, the Verkhovna Rada of Ukraine adopted a new draft law on mobilisation without any proposals from the relevant committee. It is expected to be voted on as a whole at the end of February, and the draft law may come into force in April.

The draft law proposes, among other things, to introduce summonses through the conscript’s electronic cabinet. Other innovations include lowering the conscription age to 25 years, setting the demobilisation period at 36 months, introducing voluntary mobilisation for convicts, restrictions on evaders, banning civil service without military training, etc.
