The Cabinet of Ministers submitted a bill to the Rada to liquidate the MSEC: what it provides for

The Cabinet of Ministers has submitted a bill to the Verkhovna Rada to liquidate medical and social expert commissions (MSECs). This was announced by the government’s permanent representative in the Verkhovna Rada, Taras Melnychuk, Komersant ukrainskyi reports

“The Cabinet of Ministers … registered in the Verkhovna Rada of Ukraine the draft Law “On Amendments to Certain Legislative Acts of Ukraine on the Implementation of the Assessment of the Daily Functioning of a Person” (Reg. No. 1️2️1️7️8️). The bill is aimed at… reforming the system of medical and social expertise in Ukraine,” he wrote.

“The document proposes to amend a number of legislative acts, including the Fundamentals of Ukrainian Healthcare Legislation, the Laws on Rehabilitation in Healthcare, on the Fundamentals of Social Protection of Persons with Disabilities in Ukraine, and others.

The draft law proposes to

  • replace the outdated system of medical and social assessment of persistent disabilities of adults with an assessment of a person’s daily functioning, which will facilitate more efficient medical examination and, if there are grounds for it, provide mechanisms for legal protection at the stages of possible appeal of decisions;
  • to establish that the assessment of a person’s daily functioning is carried out by the relevant expert commissions formed in cluster and supercluster healthcare facilities, whose members bear civil, administrative and criminal liability in accordance with the law;
  • to consolidate the list of functions of expert commissions and include, in particular, the establishment of a disability group, referral of a person for additional examination, planning and conducting a second examination, etc;
  • to establish that a medical report on temporary disability is issued for the entire duration of the condition that leads to temporary disability;
  • to establish rules for the development of an individual rehabilitation program for a person with a disability and requirements for its content, which will include four sections: the result of an assessment of the person’s daily functioning; an individual plan for the provision of social services; an individual educational trajectory; an individual employment plan, etc.

As stated in the explanatory note to the draft law, its main task “is to simplify the process of establishing disability by formalizing the relevant criteria and regulating procedures; digitalizing the examination; introducing transparent appeal mechanisms; changing the mechanism for financing medical and social examinations.”

It is noted that the draft law has already been submitted to the Committee on National Health, Medical Care and Health Insurance.

Earlier it was reported that all medical and social commissions in Ukraine would cease to operate by December 31, 2024. This became possible because the President of Ukraine Volodymyr Zelenskyy enacted the relevant decision of the National Security and Defense Council.

As a reminder, on October 5, employees of the State Bureau of Investigation detained and notified the head of the Khmelnytsky Regional Center for Medical and Social Expertise of suspicion of illicit enrichment.

Prior to that, on October 3 and 4, law enforcement officers conducted a series of searches in the official’s offices and at the place of residence of the official and her close relatives.

The head of the MSEC was found to have $100,000 in her office, as well as a number of forged medical documents, lists of “evaders” with fake names and fake diagnoses.

At the home of the official and her relatives, SBI officers found almost $5 million 244 thousand, 300 thousand euros, more than UAH 5 million, branded jewelry and jewelry.
