Head of Odesa Regional Administrative Court Kiper sues for prosecutor’s pension
24 October 13:34Oleh Kiper, head of the Odesa Regional Administrative Court, won the case against the Pension Fund. Now he has to recalculate his seniority and receive a pension for his years of service as a former prosecutor. The relevant materials are contained in the Unified Register of Pre-trial Investigations, Komersant Ukrainian reports
The name of the plaintiff is not disclosed in the text, but according to Channel 24, it is Oleh Kiper, as he submitted full details of his official work and positions for the trial.
The Kyiv District Administrative Court has ruled that 44-year-old Oleh Kiper is a “pensioner”.
The proceedings were opened on 12 April 2023. Kiper was the prosecutor of the capital from September 2020 to May 2023, so the court decision states that the plaintiff “continues to work in the prosecution authorities of Ukraine as the head of the Kyiv City Prosecutor’s Office”.
In order to receive his pension, Kiper needed 25 years of service, of which at least 15 years had to be spent working in the prosecutor’s office.
The Pension Fund refused to grant Oleg Kiper a long service pension. The fund explained its decision by saying that the official did not have enough seniority – he had only worked in the prosecutor’s office for 23 years, while 25 years were required for the calculation of payments.
The official appealed the decision. According to him, the time he spent studying full-time at the Odesa Law Academy was not included in his seniority.
In this regard, on 7 August 2023, the Kyiv District Administrative Court ordered the Main Department of the Pension Fund of Ukraine in Chernivtsi Oblast to grant Kiper a long-service pension from 6 February 2023 in accordance with Article 86 of the Law “On the Prosecutor’s Office”.
The pension of the head of the IAB will amount to 60% of his monthly salary, including all types of payments from which a single social contribution is paid.
