MPs want to harmonize legislation so that police can open Ukrainian parcels without any problems
11 December 17:42The Verkhovna Rada has registered a draft law on amendments to the Criminal Procedure Code of Ukraine to bring some of its provisions in line with the Law of Ukraine “On Postal Service”. This was reported on the website of the Verkhovna Rada, Komersant ukrainskyi reports.
The draft law is intended to harmonize the provisions of the Criminal Procedure Code of Ukraine with the new legislation in the field of postal services.
“Given that the regulation of general procedures for organizing and conducting relevant covert investigative (detective) actions is inextricably linked to special legislation in the field of postal services, there is an objective need to amend certain articles of Chapter 21 of the CPC of Ukraine, in particular, the articles regulating the procedure for organizing and conducting covert investigative (detective) actions regarding postal correspondence,” the explanatory note to the draft law states.
Managers and employees of the postal operator will be obliged to provide conditions for conducting covert investigative (detective) actions and not to disclose the fact of their conduct or the information received.
The amendments to the Criminal Procedure Code of Ukraine stipulate that the inspection of detained mail is carried out at postal facilities with the participation of a representative of the postal operator, and, if necessary, with the participation of a specialist.
“If things (including substances) or documents relevant to a particular pre-trial investigation are found in postal items at postal facilities, the investigator, within the limits determined by the decision of the investigating judge, seizes the relevant postal items or is limited to making copies or obtaining samples from them. If necessary, the person inspecting such items may decide to apply special markings to the found items and documents, equip them with technical means of control, replace items and substances that pose a threat to others or are prohibited from free circulation with their safe counterparts,” the document says.
The draft law was submitted for review to the Verkhovna Rada Committee on Law Enforcement the day before.
