Antimonopoly Committee fines Delta Medical UAH 9.5 million for manipulative advertising

The Antimonopoly Committee of Ukraine (AMCU) has fined Delta Medical LLC UAH 9.5 million for disseminating false information about the properties of the dietary supplement Lactofiltrum. This was reported by "Komersant Ukrainian" with reference to the AMCU press service.
The AMCU issued a decision recognizing the actions of Delta Medical LLC as a violation under Article 15-1 of the Law of Ukraine “On Protection Against Unfair Competition”. The company was accused of disseminating misleading information to consumers.
What was the nature of the violation?
The proceedings were initiated on the basis of a complaint filed by Orisil-Pharm LLC, a manufacturer of the Eliminal Gel dietary supplement. The essence of the complaint is the use of misleading advertising claims that could influence consumers’ decisions.
DELTA MEDICAL LLC advertised Lactofiltrum with statements that the product
- helps to cleanse the body;
- restores microflora
- improves skin condition;
- helps with allergies, acne, poisoning and other diseases.
The advertising materials were distributed on the Internet, Instagram, Facebook, and television, without any proper evidence of the product’s effectiveness.

Response of the Ministry of Health and conclusions of the AMCU
The Ministry of Health of Ukraine reported that the claimed medicinal properties do not comply with the law. Accordingly, such information may mislead consumers and create unfair market advantages.
The AMCU found that such actions led to an unlawful strengthening of the competitive position of Delta Medical LLC – not due to innovations or product quality, but due to the dissemination of false information.
Consequences for the company
The Antimonopoly Committee:
- imposed afine of UAH 9,500,000;
- ordered to cease the violation within two months from the date of receipt of the decision.
In addition, it is worth noting that the company has already been held liable for a similar violation in December 2024, which was an aggravating factor in determining the amount of the new fine.
